T-Mobile Class Action Lawsuit
In January 2008, Giskan Solotaroff Anderson & Stewart filed a class action lawsuit against T-Mobile USA, Inc. (“T-Mobile”), on behalf of all T-Mobile customers who have been charged and paid undisclosed roaming rates for voicemail message notifications and unanswered calls received while traveling outside of the United States.
I. Plaintiff’s Factual Allegations
As set forth in the complaint, lead Plaintiffs allege, on behalf of a class of similarly-situated consumers, that T-Mobile charges, in the absence of sufficient prior disclosure, up to $3.98 for every voicemail message notification left on the customers’ mobile phones while the customers are traveling outside of the United States, even if the customers do not check their voicemail. These charges appear on customers’ bills as calls to Santa Barbara, California at telephone number 805-637-7249. If the customers do check their voicemail, they are assessed an additional per minute roaming charge. T-Mobile also charges, in some instances, up to $3.98 for every unanswered call received while the customers are traveling outside the United States.
II. Relief Sought
The class action complaint specifically seeks:
(1) to enjoin T-Mobile from charging for voicemail notifications and unanswered calls absent adequate disclosure; and
(2) the awarding to Plaintiffs of damages and restitution.
III. The Proposed Class
Plaintiffs seek to represent a class consisting of all customers of T-Mobile in the United States who were charged roaming fees for voicemail messages and/or unanswered calls received while traveling outside of the United States.
