CitiMortgage Loan Modification Class Action

A class action has been filed against CitiMortgage, on behalf of homeowners in New York who have been wrongfully charged late fees and had their credit–worthiness ruined as a result of participating in a HAMP loan modification program with CitiMortgage.

I. Factual Allegations

This action has been brought on behalf of New York homeowners who have participated in the HAMP loan modification program with CitiMortgage and who have not received a permanent loan modification within 90 days, despite complying with the trial period guidelines. As alleged in the complaint filed on February 22, 2011, CitiMortgage has failed to honor its loan modification agreements with homeowners and has made material misrepresentations and non–disclosures about the loan modification program. As a result, homeowners have found themselves in a worse position financially than before they entered into the HAMP loan modification with CitiMortgage.
