JP Morgan Chase & Co. Home Mortgage Class Action Lawsuit

In September of 2004, Giskan Solotaroff & Anderson LLP initiated a claim against JP Morgan Chase & Co. (“Chase”) on behalf of a class of consumers who obtained home mortgages through Chase and were charged a “post-closing” or “post-closing review” fee.

  1. Plaintiffs' Factual Allegations

    As set forth in the amended complaint, filed in October of 2007, lead plaintiff alleges, on behalf of a class of similarly situated consumers, that Chase forced persons who obtained or refinanced a home mortgage through Chase to pay fees of approximately $225-$275 per mortgage at the time of the real estate settlement and closing. Chase does not, however, inform consumers of how the amount of this fee is calculated, or what compensable services it will provide them in exchange. Plaintiff believes the post closing fee is an unearned or "junk" fee for which no services are provided in exchange.

  2. Settlement

    In August 2009, the parties entered into a settlement agreement in which class members are entitled to a refund of 100% of the Post Closing Fee they paid, plus interest.
